FAMILY DISPUTE RESOLUTION

 

We are registered family dispute resolution providers, who offer family dispute resolution services in accordance with the Family Law Act 1975.

 

We assist separating couples and families to reach agreements in the following areas:

 

* parenting plans;

 

* children's issues, using child-inclusive processes;

 

* family and relationship issues; 

 

* interim and final arrangements;

 

* financial arrangements;

 

* business and property.

 

You may be aware of the recent changes to the family law system that make it compulsory for all separating parents to attempt family dispute resolution before filing a court application  for a parenting order. Parents now require a certificate from a registered family dispute resolution provider, such as CSA, to confirm that an effort has been made to resolve the issues out of court.

 

In accordance with these changes, we have found that reaching agreement through mediation and dispute resolution processes results in better outcomes for families and children. Recent research has confirmed that parental conflict is extremely damaging for children and adversarial processes have been found to exacerbate conflict. Dispute resolution processes aim to facilitate cooperative parenting and to protect children from parental conflict.

 

In our processes, we assist parents to focus on the best interests of their children and how to work effectively with their legal advisors.

 

Val Sinclair, Principal of CSA, has been a dispute resolution practitioner for 16 years and CSA practitioners are registered providers in accordance with the Family Law Act. Val is also one of the few providers registered to provide Child Inclusive processes working with experienced Child Specialists in a mediation process.

 

Danielle Jaku-Greenfield practised as a solicitor in family law before training as a family dispute resolution practitioner, and has completed a Masters in Law, which critically appraises the recent changes to the Australian family law system.
